New Substance Notification

Many jurisdictions around the world have implemented notification schemes to regulate the import, marketing or manufacture of chemical substances. Examples include the Canadian New Substances Notification Regulations (NSNR) under the Canadian Environmental Protection Act (CEPA); the U.S. Pre-Manufacture Notification (PMN) requirements under the Toxic Substances Control Act (TSCA); the European Registration, Evaluation and Authorisation of Chemicals (REACH); and the Australian National Industrial Chemicals Notification and Assessment Scheme (NICNAS) of the Industrial Chemicals (Notification and Assessment) Act. All these regulations require respective governments to be notified prior to the "domestic" import, marketing, or manufacturing of "new" chemical substances.

  • Interpretation of Notification Schemes from both a scientific and regulatory perspective; 
     
  • Classification of Substances and/or products to determine the need for, and nature of, pre-manufacture/pre-importation/pre-marketing notifications; 
     
  • Development of Notification Strategies that are designed to support not only regulatory compliance, but also the client’s business objectives; 
     
  • Design and Implementation of Testing Programs to establish the safety-in-use of new substances in accordance with national and international notification requirements; 
      
  • Stewardship of Testing Programs including the development of test protocols, and placement and monitoring of studies within qualified contract laboratories; 
      
  • Development of Technical Substantiation Reports that defend the use of surrogate data, method variations or requests for waivers of test requirements, where permitted; 
     
  • Preparation of Notification Dossiers that are sufficiently detailed and quality controlled to ensure prompt acceptance and assessment by the regulatory authorities; 
     
  • Pre- and Post-Notification Consultation with the regulatory authorities on matters relating to the notification and assessment of new substances; and 
     
  • Technical Support to Legal Advisors to assist in the resolution of notification non-compliance issues.
