Nutrition & Health Claims Europe - Designing Clinical Studies for Success

Section of Administrative Law & Regulatory Practice Annual Meeting

The EU and Canada are both implementing new, ambitious programs that provide models, and cautionary experiences, for U.S. reforms. The EU’s REACH program has been widely criticized for needless expense and complexity and for producing slow results. The Canadian Environmental Protection Act, by contrast, is frequently cited by stakeholders as a better approach.

This program focused on the features of CEPA that makes it apparently more efficient and productive. Also, it explored how compatible those processes would be with U.S. law and expectations regarding transparency, participation and due process.

Planning for your Business and Protecting your Products Under CEPAs Chemicals

On December 8, 2006, the Canadian government pledged to spend $300 million over four years to implement their Chemicals Management Plan. Four years later, where do we stand? Environment Canada and Health Canada have together categorized the Domestic Substance List into high, medium and low priorities for action. Together they have now assessed 200 chemical substances identified as high priorities for action under the initiative known as “The Industry Challenge.” These substances were predisposed to being declared “CEPA Toxic” and were anticipated to be subject to severe restrictions, including possible bans.

This webinar briefly reviewed “The Industry Challenge”, and provided an update on the fate of the 200 high priority substances – industry participation, the assessment outcomes, the proposed risk management, and, most importantly, the foreseeable impact on the chemical industry and our downstream stakeholders. The presentation ended with a discussion of “what’s next”, including international collaboration activities and the proposed path forward for the 3000 medium priority substances and the remaining low priorities.

A Complimentary Intertek Webinar

The Turkish Chemicals Inventory and Control Legislation, also known as the Turkish Chemical Regulation, imposes obligations on importers and manufacturers to notify the Turkish Ministry of Environment and Forestry of existing and new chemical substances, either on their own or in preparations. The chemical data requirements depend on the tonnage per annum manufactured or imported into Turkey.

After March 31, 2011 a submission must be made each year to Turkish authorities for all substances manufactured in or imported into Turkey in quantities greater than 1 tonne per annum.

Scientific requirements and regulatory processes for claim substantiation have changed in Canada , the European Union (EU), and the United States (US). Across all 3 jurisdictions, there is increased scientific rigor, transparency, and comprehensiveness for claim substantiation. Without knowledge of what is expected and the right tools to meet the expectations, the process of claim substantiation can appear daunting and/or lead to unsuccessful applications. Cantox conducted a 2-day workshop that guide you through the “what” and “how” of claim substantiation - what the science is, how the science is met, and how claims are regulated. Both the science and regulations of claims in Canada , the EU and the US were presented, in addition to key recent developments pertaining to claims in each jurisdiction. Systematic approaches, tools, and key principles for claim substantiation, which can be applied to all jurisdictions, were shared, in addition to aspects related to the design of clinical trials for health claim substantiation. Today’s consumers are increasingly choosing the ‘healthier alternative'.

In January 2008, the Government of Canada launched Canada's Food and Consumer Safety Action Plan. A key element of this initiative was ensuring that consumers can make more informed choices about health products and their own health. As a relatively new class of products, NHPs in food format pose novel challenges for assuring informed choice. Some considerations for products at the food-NHP interface have already been raised; such as the challenge of ensuring that such products are taken according to the conditions of use and not easily mistaken for foods, or that they be used by the appropriate populations and not be consumed ad-libitum. Other considerations/challenges remain to be identified.

As a recognized expert in the food and nutrition industry, Ms. Lina Paulionis, Cantox Health Sciences, was asked to participate in the discussion of the challenges of NHPs in food format.

How will EU regulation shape our choices? A new report from our Business Forum. Health claims underpin one of the most prominent food industry trends of the past decade: developing and marketing 'functional foods'. While this trend has been most evident in manufacturing, it has in fact extended all the way from the supermarket shelf through to agricultural inputs. Reports in 2008 claimed that consumer skepticism was dampening the market for functional foods and demanding more robust evidence to back up health claims. With the European Commission (based on the stringent scientific advice of the European Food Safety Authority) set to pronounce which health claims will be allowed in future, the market is due to get tougher still. J. Respir. Cell Mol. Biol. 37:300-308). The bar was set high this year with the excellent research that has been conducted by SOT postdocs, leaving the PDA Board and external reviewers with some really tough decisions. Dr. Jeffrey Card was presented with his award at the SOT Annual Meeting during the Postdoctoral Luncheon.

Ms. Levins discussed existing-chemical legislation activities in the European Union (EU), the United States (US) and Canada by comparing the EU's REACH (Registration, Evaluation, Authorisation and Restriction of CHemicals) to US's CHAMP (CHemical Assessment and Managment Program) and to Canada's CMP (Chemicals Management Plan). Her presentation on Key Chemical Control Legislation in North America, provided an overview and update on the progress of several key initiatives regarding chemical inventories, new chemical assessments, and existing substance reviews in Mexico, the United States , and Canada.

More than 80,000 chemicals are registered for use in the United States. Each year, an estimated 2,000 new ones are introduced for use in such everyday items as foods, personal care products, prescription drugs, household cleaners, and lawn care products. We do not know the effects of many of these chemicals on our health, yet we may be exposed to them while manufacturing, distributing, using, and disposing of them or when they become pollutants in our air, water, or soil. Relatively few chemicals are thought to pose a significant risk to human health. However, safeguarding public health depends on identifying both what the effects of these chemicals are and at what levels of exposure they may become hazardous to humans-that is, understanding their toxicology. The NTP is an interagency program whose mission is to evaluate agents of public health concern by developing and applying tools of modern toxicology and molecular biology. The program maintains an objective, science-based approach in dealing with critical issues in toxicology and is committed to using the best science available to prioritize, design, conduct, and interpret its studies. To that end, the NTP is continually evolving to remain at the cutting edge of scientific research and to develop and apply new technologies.

Dr. Earle Nestmann, Cantox Health Sciences, was an invited speaker at this years meeting, and presented 'Comments on the Draft Substance Profile for Styrene - Genotoxicity' on February 24, 2009.
